This Tune Outdoor LLC Purchase Order (this “Order”) is between Tune Outdoor LLC (“TUNE OUTDOOR”) and the undersigned customer (“Customer”) and is effective as of the date this Order has been signed by both Tune and Customer (the “Effective Date”). By signing this Order, the parties agree to the pricing and additional terms set forth herein for Customer’s purchase of the camper and equipment (the “Products”) as described in the invoice and dated as of the Effective Date (the “Invoice”), all of which such Products shall be provided pursuant to Tune Outdoor’s Terms of Use (the “Terms”) and Limited Warranty (the “Warranty”), each of which are hereby incorporated into this Order by reference. Capitalized terms used but not defined in this Order shall have the meanings given to such terms in the Terms and the Warranty. In the event of any conflict between this Order and the Terms, the provisions of this Order shall prevail.
By signing the Invoice, the Customer agrees to pay the amounts set forth on the applicable Invoice for the Products listed on such Invoice prior to the production of any Tune M1 campers or shipment and installation of third party Products and merchandise.
USE OF THE PRODUCTS PURCHASED PURSUANT TO THIS ORDER IS SUBJECT TO THE TERMS AND THE WARRANTY, INCLUDING THE DISCLAIMERS AND LIMITATIONS OF LIABILITY SET FORTH THEREIN. BY SIGNING THE PURCHASE ORDER YOU HEREBY AGREE THAT YOU HAVE READ SUCH TERMS AND WARRANTY AND AGREE TO BE BOUND BY THEIR TERMS AND CONDITIONS.
You also hereby agree that you shall use the Products in accordance with the Care and Usage Guidelines and such similar instructions as may be made available to you by Tune Outdoor at installation, via email or on the Tune website.
Except as expressly provided in the Terms and the Warranty, all payments are non-refundable and early termination of the Order shall not entitle the Customer to any refund of fees or payments.
